Our Responsibilities

  1. Site observation, measuring and initial site survey. The Consultant shall not do exploratory demolition to determine the condition of any existing structures. They are not expected to remove attached covers, make holes, or perform tests that could damage the item or area being observed.
  2. Preparation of preliminary design and presentation to the Client.
  3. Preparation of final design, in accordance with the Client’s response to the preliminary design. The concept design phase generally consists of two design revisions (SK1 to SK2). Design changes beyond this number will result in additional architectural fees.
  4. Preparation of planning drawings based on finalised design. Any changes after this point, requested by either the Client or the local planning authority will be a chargeable expense.
  5. Submission of drawings to the local planning authority. The Consultant will act as the agent on behalf of the Client and liaise with the local authority throughout the planning process.
  6. Preparation of detailed construction documents.
  7. Issue of detailed construction documents for tender to up to three local contractors, if required.
  8. All specialist information required, including but not limited to steel calculations, surveying, ecology surveys and contamination testing will be conducted by specialist contractors. The Consultant will coordinate any requested or required information of this nature and make the Client aware of any additional costs; this may incur a handling fee.

Clients Responsibilities

  1. Provide full information about the objectives, schedule, and constraints of the project. The designer may rely on the accuracy and completeness of information furnished by the Client.
  2. Establish a budget with reasonable contingencies that meet project requirements.
  3. Agree to the supply of all requested information required to complete the proposed works as agreed with the Consultant. This includes any surveying, engineering and environmental testing.
  4. Employ a contractor to perform the construction work and provide cost-estimating services after the completion of the preliminary design and before the preparation of the final construction documents.

General Conditions

  1. The Client has the right to cancel the architectural services at any time for any reason and will be responsible for payment of services performed up to the date of cancellation. Any cancellation of architectural services shall be done in writing.
  2. Requested site visits or meetings from either the Client or the local authority will be a chargeable expense, including all travel time.
  3. Drawings for Client approval will be submitted by email, unless specifically requested by the Client.
  4. Revisions or alterations to any planning drawings requested after planning submission will be a chargeable expense, unless such revisions are made necessary by the Consultants error or omission.
  5. Co-Create Ltd shall be compensated for reimbursable expenses including additional hard copies and postage costs. 1 hard copy of the final drawings shall be provided for each work stage.
  6. If the Client fails to make payment on any undisputed amount, then the Consultant has the right to suspend work and shall not be held responsible for any delays as a result.
  7. Payments shall be made by BACS or Bank Transfer. All payments via cheque will incur a fee. Payments are due and payable within 30 days of the Client’s receipt of the invoice. Undisputed amounts not paid within 30 days after the invoice issue date shall bear interest from the date payments are due at a rate of 2% per month.
  8. The architectural fees listed in this agreement shall be valid for 12 months from the date shown. Architectural fees may be increased if services are required beyond 12 months.
  9. Revisions or alterations to any technical drawings requested after the final issue will be a chargeable expense, unless such revisions are made necessary by the Consultants error or omission.
  10. Changes in the scope of works requested by the Client that are inconsistent with Client’s prior approval of the final design drawings may result in additional work and shall be considered beyond the scope of any agreement. The Consultant will notify the Client, prior to commencement of the additional services and of any time delays and additional fees that will be incurred.
  11. All sub-consultant fees, planning application fees, building regulation fees and survey maps are not included as part of the architectural fees. Any specialist information of this nature will be an additional cost chargeable to the Client.
  12. The costs associated with any structural modifications/redesign and or repairs required because of unforeseen conditions uncovered during demolition/construction, shall be the responsibility of the Client.
  13. The Consultant will make every effort to work within the design budget as set forth by the Client, or notify the Client should any cost restrictions occur. The Consultant cannot be held responsible for significant changes for labour and material costs in the construction market.
  14. The Consultant shall have no responsibility for the identification, discovery, handling, removal or disposal of hazardous materials in any form on site.
  15. The Consultant may visit the site at intervals appropriate to the stage of construction to become familiar with the progress and the quality of the work and to determine if the work is being performed in accordance with the drawings. They shall not be required to make continual on-site inspections. They shall make themselves reasonably available for any additional site visits requested by the Client. The Consultant shall have reasonable access to the work wherever it is in its preparation or progress.
  16. Co-Create Ltd retains the right to all works produced. Co-Create Ltd has the right to use any drawings and photographs taken before, during or after construction for any purposes.
  17. The Client shall be issued a copy of the any final design documents. They may use this copy for the purposes of completing or maintaining the project and for future alterations and additions.
